Abstract The article examines the procedural activities of the Prosecutor at the opening of criminal proceedings according to the legislation of Ukraine and foreign countries. The peculiarities of application of norms of the code of criminal procedure, the criminal procedure codes of post Soviet countries and Europe. The proposals for amendments to the legislation, taking into account experience of foreign countries.
